Conditions of Use and Liability

Scope of Services

Pikturat provides patent documentation management and trademark defense strategy services under the Patents and Designs Act of Nigeria. All engagements are governed by a written agreement that specifies the deliverables, timelines, and fees. No service is rendered without a signed contract.

Clause 1
Client Obligations

The client must supply accurate and complete information regarding their intellectual property portfolio. Failure to disclose material facts may result in termination of the engagement and forfeiture of any fees paid. The client is responsible for maintaining the confidentiality of their own credentials and access rights.

Clause 2
Limitation of Liability

Pikturat's liability for any claim arising from its services is limited to the total fees paid by the client in the twelve months preceding the claim. Under no circumstances shall Pikturat be liable for indirect, incidental, or consequential damages, including loss of business or IP rights, even if advised of the possibility.

Clause 3
Intellectual Property Rights

All materials, reports, and strategies prepared by Pikturat remain the intellectual property of Pikturat until full payment is received. Upon payment, the client receives a non-exclusive, non-transferable license to use the deliverables for their intended purpose. Pikturat retains the right to use anonymized case data for internal analysis.

Clause 4
Termination

Either party may terminate the agreement with thirty days' written notice. In the event of a material breach by the client, Pikturat may terminate immediately. Upon termination, the client must pay for all services rendered up to the effective date. No refunds are provided for partial months or unused portions of a retainer.

Clause 5
Modifications

Pikturat reserves the right to modify these terms at any time. Clients will be notified of material changes via email at least fourteen days before they take effect. Continued use of services after the effective date constitutes acceptance of the revised terms. Clients who do not agree may terminate without penalty within the notice period.
